What are my obligations as an SMSF trustee?

As a follow-on from our recent blog article (SMSF: Is it right for me?), I wanted to dive further into your obligations are as a trustee.
As an SMSF trustee, you’re legally responsible for the fund. This means acting honestly, exercising care and diligence, and always making decisions in the best financial interests of all members. You must also ensure your fund complies with super laws and your trust deed, and that no one accesses benefits early.
Understanding the Sole Purpose Test
Your SMSF must exist solely to provide retirement or death benefits. You cannot use the fund for personal gain or to benefit related parties. This includes:

Investing in ways that primarily benefit family or related parties
Breaching this rule can lead to penalties and loss of tax concessions.
Managing Contributions and Investments
Trustees must ensure contributions and rollovers are correctly allocated and documented. You also need a clear investment strategy that:
Reflects members’ circumstances and goals
Considers diversification, liquidity, and insurance needs
Is reviewed regularly
Every investment must align with this strategy and be properly documented.
Ongoing Compliance
Running an SMSF requires ongoing administrative obligations, including:
Preparing financial statements
Arranging an annual independent audit
Lodging your SMSF Annual Return (SAR) on time
Keeping accurate records and ensuring the fund meets Australian residency rules
Staying on top of these obligations is critical—non-compliance can lead to penalties or higher tax rates.
